% 01.03.2017 IA No.2643/2017 (of the defendant no.3 under Section 124 of the Trade Marks Act, 1999).

The counsel for the plaintiff appears on advance notice and on enquiry states that the plaintiff has no objection to the adjournment sine die of the suit including for the relief of passing off, awaiting the outcome of the rectification petition filed by the plaintiff before the Intellectual Property Appellate Board (IPAB).

I have in order dated 9th February, 2017 in CS(OS) No.1499/2016 titled Dabur India Ltd. Vs. Alka Ayurvedic Pvt. Ltd. also filed by the plaintiff, instead of adjourning the suit, disposed of the suit with liberty to revive as and when need arises.

Following the same, the suit is disposed of with liberty to the parties to apply for revival as and when need arises. 4.
