O R D E R

% 20.07.2018 The matter is taken up on an office notice dated 16.07.2018 of the Registrar General of this Court in view of the minutes dated 16.10.2017 of the Hon'ble Administrative and General Supervision Committee of this Court to the effect that "that earlier resolution of the Administrative and General Supervision Committee held on 28.09.2015 regarding item no.8 authorising Principal Judge (Headquarters), Family Courts, Dwarka to consider the request for transfer of the cases from the Family Court Judges on their recusal to hear the cases and to assign the same to another Family Court in the same District or in the nearest District, as he/she deems fit, is recalled.

Therefore, henceforth the request received from District and Sessions Judges and Principal Judges, Family Court for transfer of case from one District to another District, subordinate to the High Court and competent to try or dispose of the same, upon recusal of for any other reason, shall be placed by the Registry by way of reference before the concerned Bench for appropriate consideration and orders. The same be done for the item no.2 and 3."

Vide proceedings dated 11.07.2018 of the District & Sessions Judge (East) i.e. the RCT (East) it was observed to the effect that the tenanted premises in question fall within the territorial jurisdiction of the District Shahdara and the RCT (East) lacks the jurisdiction to hear the appeal. The tenanted property is stated to be C-1/14, Krishna Nagar, Delhi as per the impugned order dated 23.05.2015 placed on the record. In view of the observations in the order dated 11.07.2018 of the RCT (East), the proceedings of RCT No.165/2016 pending before the RCT (East) i.e. the District & Sessions Judge (East) are withdrawn from the said Court and assigned to RCT, Shahdara i.e. District & Sessions Judge, Shahdara where the record of RCT No.165/2016 be placed on the date 07.08.2018 at 2:30 pm with the parties having been directed to appear on the said date.
