% 26.07.2016 This is a petition for quashing of FIR No. 163/2012 under Sections 498A/406/34 IPC registered at PS CAW Cell Nanakpura, New Delhi on the complaint of Respondent No.2 as the parties have settled the matter. The complainant/Respondent No. 2 is present in Court and is identified by her counsel and the Investigating Officer. She states that she has settled the matter with the petitioners and divorce by mutual consent has already been granted between petitioner No.1 and respondent No.2. A sum of `48,50,000/- has been settled to be paid to the respondent No.2 out of which she has already received a sum of `46,50,000/- and the balance amount of `2 lakhs has been received by her today in Court out of which `1,50,000/- is by way of a cheque. She further states that in view of the settlement between the parties, she does not want to pursue the abovementioned FIR and the proceedings pursuant thereto. CRL.M.C. 2610/2016
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No. 163/2012 under Sections 498A/406/34 IPC registered at PS CAW Cell Nanakpura, New Delhi and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court. Petitioner No.2 and 3 being aged and petitioner No.5 having suffered a fracture and undergoing treatment are not present in Court today. They are exempted from personal appearance. The petition is disposed of. Order dasti.
