The parties have filed this application under Order 23 Rule 3, inter alia, stating that the parties have settled their disputes in terms of the settlement recorded in paragraph 2 of the present application. 2.

In terms of the settlement, the defendant has, inter alia, confirmed that they have ceased the use of the trademark 'COSTCO' and further do not have any stock of any products bearing the said trademark. The plaintiffs have also given up their claim for delivery of goods, rendition of accounts, damages and costs.

The settlement arrived at between the parties is lawful. Accordingly, the suit is decreed in terms of the settlement arrived at between the parties. The parties to bear their own costs.

Let a decree sheet be drawn up. The present application shall form a part of the decree sheet.

The prayer for return of the Court Fee is declined. 6.
