Declared as Proclaimed Offenders, petitioners want the order passed by the learned Metropolitan Magistrate declaring petitioners to be absconders to be quashed and also want the FIR and proceedings emanating therefrom to be quashed.

Learned counsel for the petitioners states that since the petitioners intend to settle the dispute with the complainant, it being a money matter, instant petition may be permitted to be withdrawn granting liberty to the petitioners to seek quashing upon settling the dispute with the complainant and having recorded the settlement reduced in writing. Granting liberty as prayed for with the further condition that if a settlement takes place the written settlement would be annexed with the petition with the complainant joined as co-petitioner and presence ensured on the first date, instant petition is dismissed as not pressed.
