My attention has been drawn by the counsel for the petitioner to the order dated 13.7.2017. As reflected in the said order, a settlement was arrived at between the parties whereby the respondent company was to pay a total sum of Rs.1 crore to the petitioner. I am informed by the counsel for the petitioner that a sum of Rs.60 lakhs has already been paid and the balance sum of Rs.40 lakhs remains to be paid. This order also indicated that insofar as interest is concerned, parties would settle the issue in November 2017. Counsel for the petitioner says that the petitioner would be satisfied if the balance sum of Rs. 40 lakhs is paid as agreed between the parties.

Accordingly, the company petition is disposed of with the direction to the respondent company to file an undertaking of its director stating therein that the balance sum of Rs.40 lakhs would be paid as per the agreed terms, failing which petitioner would be
free to take out appropriate proceedings in accordance with law. The said affidavit will be filed by the director of the respondent company within ten days from today.
