The counsel for the plaintiff states that though this suit has been numbered as a commercial suit but as per the amended plaint the claim in the suit is for recovery of Rs.24,97,850/- with interest and the valuation of the suit for the other relief of declaration claimed in the suit does not also take the suit till the figure of Rs.1 crore.

The counsel for the plaintiff however states that he withdraws IA.No.5637/2016.

The counsel for the defendant No.1 as well as counsel for the defendant No.2 have no objection.

The address of the defendant No.1 which is the main contesting defendant is of Sainik Farm, Neb Sarai. The counsels state that the same falls within the jurisdiction of District Judge (South) Saket Courts, New Delhi.
