BAIL APPLN. 1413/2016 Issue notice.

Learned APP accepts notice on behalf of the State. By the present petition the petitioner seeks anticipatory bail in case FIR No.487/2014 under Sections 420/468/471/120B IPC registered at PS Fateh Pur Beri, Delhi on the complaint of Smt. Shanti Devi. Learned APP for the State on instructions from the Investigating Officer submits that the main accused Chhinder Pal Singh was arrested and granted regular bail. His specimen signatures have been taken. On a query raised by the Court learned APP on instructions states that the petitioner has joined the investigation.

The allegations in the FIR are that Smt. Shanti Devi was looking for purchasing a plot when Amar Kumar, the present petitioner introduced Chhinder Pal Singh to the husband of the complainant whereafter a deal for purchase of a plot admeasuring 120 Sq. Yards in Asola Housing Complex was entered into. At the time of agreement to sell a sum of `2 lakhs and thereafter a further sum of `2 lakhs was given in cash. The balance amount of `24.50 lakhs was given through cheque. While the complainant was constructing the boundary wall it was revealed that Chhinder Pal had sold the property on forged and fabricated documents. The only role attributed to the petitioner is that as property dealer he introduced Chhinder Pal Singh to the husband of the complainant. The main accused has already been arrested and his specimen signatures have already been taken. Charge sheet qua Chhinder Pal Singh has been filed.

Considering the facts and circumstances of the case, I deem it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with two sureties of the like amount subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer and he will not leave the country without prior permission of the Trial Court.

Petition is disposed of. Order dasti.
