O R D E R

% 11.09.2017 At the outset, learned counsel for plaintiff wishes to delete the defendants No.3 and 4.

Accordingly, defendants No.3 and 4 are deleted from the array of parties.

Today in Court, learned counsel for parties have handed over Consent Terms/Memorandum of Settlement entered into between the plaintiff and defendants No.1 and 2. The same is taken on record. The Consent Terms/Memorandum of Settlement is also supported by an affidavit of Mr. Pavan Raghu-defendant No.2 and proprietor of defendant No.1 company.

Both the learned counsel state that the matter has been compromised in accordance with the aforesaid Consent Terms/Memorandum of Settlement.

Both the learned counsel further assure and undertake to this Court that the parties shall comply with the aforesaid Consent Terms/Memorandum of Settlement.

The aforesaid statements, assurances and undertakings given by learned counsel for the parties are accepted by this Court and parties are held bound by the same.

This Court has also perused the Consent Terms/Memorandum of Settlement and is of the opinion that they are lawful. Consequently, the suit and applications are decreed in accordance with the Consent Terms/Memorandum of Settlement dated 11th September, 2017, a copy of which is marked as Ex. C-1. Registry is directed to prepare a decree sheet accordingly.

Registry is also directed to issue to an authorised representative of the plaintiff a certificate authorizing him/her to receive back from the Collector half the amount of the Court fee paid by it in the present suit. MANMOHAN, J SEPTEMBER 11, 2017 js
