Vide the present petition, the petitioner seeks directions thereby to quash the chargesheets dated 24.01.2013 and 23.07.2013 in case bearing FIR No.387/2011 registered at Police Station Shahdra, Delhi, for the offences punishable under Sections 406/498A/34 IPC. 2.

The present petition has been filed on the ground that the matter has been settled between the parties on 30.08.2012 before the Delhi Mediation Centre, Karkardooma Courts, Delhi. As per the said settlement, the petitioner and the respondent No.2 have decided to live together at Delhi itself from the date of the settlement.

Learned counsel appearing on behalf of the respondent No.2 submits that pursuant to aforesaid settlement, the petitioner and respondent No.2 lived together in Delhi but for a short span of time and thereafter, the petitioner left Delhi and started living at Mathura. 4.

Learned counsel further submits that since then the petitioner and the respondent No.2 are not staying together, thus, there is no compromise between the parties.

Keeping in view the statement made by learned counsel appearing on behalf of the respondent No.2, I hereby dismiss the present petition as the terms and conditions of the aforesaid settlement have not been complied with.

Crl.M.A. No.17881/2013 (for stay) With the dismissal of the petition itself, the instant application has become infructuous. The same is dismissed accordingly. SURESH KAIT, J.
