O R D E R

% 29.07.2016 Petitioner is aggrieved by the fact that unauthorized and illegal construction has been permitted to respondent no.4 on his plot No.24A, Village Basant Nagar, Vasant Vihar, New Delhi. Submission is that the respondent no.4 has illegally even encroached upon the street. He has filed certain photographs to substantiate his plea. On advance notice, learned counsel for respondent no.2 and private respondent namely respondent no.4 has have put in appearance.

Status report has been filed by respondent no.2. In this status report it has been stated that unauthorized construction in the shape of ground floor up to 4th floor without any prior permission/sanction has been raised by respondent no.4 and proceedings under Sections

343/344 of the DMC Act have been initiated. Demolition order was also passed on 21.7.2016. Sealing action as also been initiated under Section 354A of the said Act. The police has also been informed vide letter dated 21.7.2016 directing them to stop this unauthorized construction forth.

Learned counsel appearing for respondent no.4 points out that against the demolition order appeal has been filed which is pending before the ATMCD and the next date fixed before the ATMCD is 02.8.2016 The respondent nos.2 and 3 will take action in accordance with law.

No further orders are called for in this petition. Petition disposed of.
