Vide the present petition, the petitioner had sought a direction to the respondent no.1 to stop and demolish the illegal and unauthorised construction over the agricultural land falling in Khasra no.171, situated at Khanpur now privately numbered as F-70, Block F, School Road, Khanpur Extn., New Delhi.

Learned counsel for the respondent no.1 states that the said respondent has already initiated appropriate demolition action in respect of the aforesaid property. He states that the sealing action programme was initially fixed for 29.08.2018, whereafter the same was deferred to 19.09.2018, but could not be carried out due to nonavailability of the requisite police assistance. He further states that

the respondent no.1 has once again fixed the demolition/sealing action programme in respect of the said property on 30.01.2019, subject to the requisite police assistance being made available. 3.

Mr.Ranjit, Sub Inspector, Neb Sarai Police Station who appears on behalf of the respondent no.2, assures the Court that the requisite police assistance will be provided to the respondent no.1 on 30.01.2019.

In these circumstances, the learned counsel for the respondent no.1 undertakes that the respondent no.1 will take appropriate action in accordance with law on 30.01.2019 and also on subsequent dates, if required.

In view of the categorical statement made by the learned counsel for the respondents that they have initiated appropriate action as per law qua the property in question, nothing further survives in the present petition and the same is disposed of as infructuous. However, liberty is granted to the petitioner to approach this Court if the need so arises.
