W.P.(C) 6224/2016 & C.M. No.25448/2016 (stay) Petitioner is stated to be vending near the S.N. DTC Bus Depot. In support of his stand he has placed on record a prosecution challan dated 11.5.2016.
Admittedly, the petitioner is not squatting at the site. His father was stated to be squatting there. The petitioner was not the original squatter. His vehement submission is that his case should be referred to the Town Vending Committee (TVC) constituted qua respondent
no.1.
Per contra, learned counsel for the respondent submits that since the petitioner was not the original squatter and as on date he is not squatting, his case for reference to the TVC does not arise. Since the challan is dated 11.5.2016 and the petitioner is not presently squatting at the aforenoted site, this Court is not inclined to entertain this challan and the present petition.
