% 29.08.2018 The petitioner admittedly is married, aged about 40 years. The prosecutrix concededly was about 15 years old around 20th June, 2014, when she was allegedly kidnapped. She was recovered from Gujarat from captivity after one and a half years. In these circumstances, the arguments of the petitioner that she had accompanied him with her consent cannot be of any consequence. There is evidence available of prosecutrix being subjected to penetrative sexual assault which has added to the charges for offences punishable under Section 4 and 12 of the Protection of Children from Sexual Offences Act, 2012.

Having regard to the stage of the case, the view taken by the trial Judge by orders dated 21.12.2017 and 05.06.2018 cannot be faulted. No good ground to release the petitioner on bail. Dismissed. Pending applications also stands disposed of. R.K.GAUBA, J.
