Cont.Cas(C) 864/2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 02nd May, 2016 passed in W.P.(C) 3650/2016 whereby the Division Bench was informed that Electronic Shops NO.11 and 12 as well as 14 and 17 at Vayusenabad had been duly approved by the Air Officer Commanding in favour of the petitioner.

Learned counsel for petitioner states that in pursuance to the aforesaid order, contract has been executed only in respect of Shops No.14 and 17 and not Shops No.11 and 12. He, however, candidly states that after the filing of the present contempt petition, petitioner has received a letter dated 21st July,

2016 issued by Squadron Leader, OIC SI Fund which states that possession of Shops No.11 and 12 shall be handed over by end of July, 2016. After receipt of the said letter dated 21st July, 2016, petitioner has also issued an Undertaking/Certificate dated 22nd July, 2016 stating that she would withdraw her contempt petition provided the Shops are allotted to her within fifteen days of receipt of letter dated 21st July, 2016. Learned counsel for respondent, who appears on advance notice states that in view of the letter dated 21st July, 2016 and the Undertaking Certificate dated 22nd July, 2016, the present contempt petition does not survive.

Having heard the learned counsel for parties and having perused the letter dated 21st July, 2016 as well as Undertaking Certificate dated 22nd July, 2016, this Court disposes of the present contempt petition and application after accepting the offer made by the respondent in its letter dated 21st July, 2016.

The petitioner is also given liberty to seek revival of the present contempt petition in the event the Shops are not allotted within the stipulated time.
