The present Transfer Petition is filed under section 24 of the CPC seeking transfer of Civil Suit No.249/2014 titled Smt.Sunita Sehgal & Ors. vs. Smt.Abha Mehta & Ors.pending in the court of Ms.Mona T.Kerketta, Civil Judge-05, West, Tis Hazari Courts, Delhi to the court of Mr.Anurag Sain, ADJ, District East, Karkardooma Courts, Delhi where Civil Suit filed by the petitioner is pending for adjudication being CS(OS)1937/2014 titled as Kartik Kapoor vs. Prabha Khattar & Ors.

Learned counsel appearing for the petitioner points out that though respondents No.1 and 4 are unserved they have been represented by common counsel alongwith respondents No.1,3,4,5,6 and 7 before the trial court.

After some arguments learned counsel for respondent No. 7 submits TRP.(C)80/2016

that instant petition may be allowed. Learned counsel for respondent No.2 has no objection in case the present Transfer Petition is allowed. 4.

Accordingly, present petition is allowed. Civil Suit No.249/2014 titled Smt.Sunita Sehgal & Ors. vs. Smt.Abha Mehta & Ors. pending in the court of Ms.Mona T.Kerketta, Civil Judge-05, West, Tis Hazari Courts, Delhi is transferred to the court of Mr.Anurag Sain, ADJ, District East, Karkardooma Courts, Delhi to be heard alongwith CS(OS)1937/2014 titled as Kartik Kapoor vs. Prabha Khattar & Ors.

Parties to appear before the concerned court in Karkardooma Courts on 3.3.2017.
