The matter is taken up today as 12th December, 2016 was declared holiday on account of 'Milad-Un-Nabi'. 2.
The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.251/2016 registered under Section 376 IPC at PS Amar Colony. Status report is on record.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. By an order dated 14.09.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has joined the investigation since then. The prosecutrix and the petitioner were acquainted with each other BAIL APPLN. 1426/2016
and lived in the same neighbourhood. Physical relations took place between the two several times albeit on the alleged promise to marry. Status report further reveals that on 12.07.2016 Ram Prakash Yadav produced an affidavit stating that his daughter wanted to marry the petitioner and when she came to know about his marriage in Bihar, she lodged the present FIR.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
