By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 Cr.P.C., petitioner has made the following prayers:- a) To call for the records of all Sentence Review Board meetings wherein the name of the petitioner was considered in respect of all the cases considered in the said meetings;

b) To call for the record/minutes of meeting in which the Sentence Review Board released other convicts who had spent lesser period in jail than the petitioner;

c) To pass an order directing the respondents to release the petitioner, who has already undergone incarceration of about 31 years with remission and about 26 years (actual).

Mr.Avi Singh, Additional Standing Counsel appearing on behalf of the State has furnished the copy of the status report to the learned counsel for the petitioner. He submits that the case of the aforesaid convict for his premature release was lastly placed before the Sentence Review Board in the meeting held on 6th September, 2017 and the result of the same is still awaited.

In view of the above submission made by learned Additional Standing Counsel for the State that the outcome of decision of the Sentence Review Board held on 6th September, 2017 is still awaited, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to avail his remedy if necessitated, depending upon the outcome of the decision of the Sentence Reviewing Board.

The writ petition is dismissed as withdrawn granting the liberty as prayed.
