The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.887/2014 registered under Sections 307/34 IPC at PS Sultanpuri. Subsequently, the petitioner was charged for committing offences under Sections 302/307/34 IPC. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 21.08.2014. Material prosecution witnesses - PW-12 (Sonu @ Sai), PW-14 (Joginder), PW-16 (Ruby) and PW-17 (Shambu Singh) have resiled from their previous statements and have opted not to support the prosecution.

They did not identify the petitioner to be one of the assailants.

No specific role has been assigned or attributed to the petitioner.

Considering the facts and circumstances of the case and the role assigned to him, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 1 lac with one surety in the like amount to the satisfaction of the Trial Court.
