% 19.05.2017 None has appeared for the petitioner. On an earlier date, it has been noted that the evidence of the petitioner could not be concluded for the reason that the plaintiff had suffered a paralytic stroke and was not in a position to appear before the Local Commissioner. On 08.12.2016, one more last opportunity had been granted to the petitioner to get fixed a date before the Local Commissioner for recording evidence of the petitioner. The report of the Local Commissioner is on record. This report evidences that the Local Commission could not be executed inspite of notice having been issued to the petitioner to get his evidence recorded. This is a clear case where the petitioner is not interested in prosecuting this litigation. None has also appeared for the petitioner today. Dismissed in default as also for non-prosecution.
