W.P.(C) 6271/2016 and CM APPL. No. 25640/2016 Petitioner is aggrieved by the unauthorized and illegal construction purported to have been carried out at flat no. 80, Loknayak Apartment, Sector-9, Rohini, Delhi-85. To substantiate this submission, learned counsel for the petitioner has drawn the attention of this Court to certain photographs at page no. 15 and 16 of the paper book.

On advance notice counsel for the respondent no. 1 has put in

appearance. His first submission is that the petitioner has given complaint with regard to unauthorized construction on the first floor of the property. As per the version of respondent no. 1 there are illegal deviations not only on the first floor but second and third floor of the property as well. It is submitted by respondent no. 1 that there is a personal vendetta between the petitioner and respondent no. 4. Be that as it may. Submission of respondent no. 1 is that in this property not only the first floor but also second and third floor already stands booked and work stop notice has been given to them and concerned SHO has also been informed of the same. Additional submission being that the first complaint has been received from the petitioner only on 08.07.2016. Further submission being that the action will be taken in accordance with law.

In view of the aforenoted undertaking furnished by respondent no. 1, no further orders are called for in this petition. Petition disposed of in the above terms.
