Learned APP accepts notice for respondent no. 1.

Respondent no.2-Ms. Nisha Khatoon is present in Court along with her counsel and accepts notice. She has been identified by SI Ompal Singh of police station Khajuri Khas.

Respondent no. 2 (wife) says that she has settled the matter with petitioner no. 1 (husband) before the Delhi Mediation Centre, Karkardooma Courts, Delhi on 3rd April, 2013 of her own free will and without any undue force, pressure or coercion. Since then, she is living with petitioner no. 1.

Respondent no. 2 further says that she has no objection in case FIR No. 70/2010 under Sections 498-A/406/34 IPC and Section 4 of the Dowry Prohibition Act, 1961 registered at Police Station Khajuri Khas on the complaint of respondent no. 2 and the consequent proceedings emanating therefrom are quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3.

Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep them entangled in the criminal proceedings. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
