% 06.10.2016 The petitioner has preferred the present petition under section 439 Cr PC to seek regular bail in case FIR No.98/2014 u/s 498A/304B/34 IPC. The petitioner is in judicial custody since 08.03.2014. The submission of learned counsel for the petitioner is that the petitioner was the father in law of the deceased. All the independent witnesses have deposed in the matter and only one formal witness remain to be examined. The further submission is that in the suicide note left by the deceased, the allegations are not against the petitioner. The petitioner is stated to be 58 years of age.
In view of the aforesaid position, there is no need to detain the petitioner in custody any further. Accordingly, the petition is allowed. The petitioner is directed to be released on bail upon furnishing personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the trial court. The petitioner shall at the time of his release provide his mobile phone number and the residential address, which shall not be changed without prior intimation to the court. He shall not contact the complainant or any of the prosecution witnesses or tamper with any evidence. The application stands disposed of.
