The present appeal under Section 96 of the CPC seeks the following prayers:- "i. allow the appeal and set aside the judgement and decree dated 28.9.2011 passed by Ms. Savita Rao, Addl. District Judge, Delhi and dismiss the suit filed by the respondent no.1 herein. ii. Cost of the appeal throughout be also allowed in favour of the appellant and against the respondent iii. Such other order or further orders be passed as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

In these circumstances, the present appeal is dismissed in default for non-prosecution and disposed of accordingly.
