% 21.09.2015 ^ The common relief sought in these two petitions is that the respondent Nos 1 to 3 be directed to pay to the petitioners gratuity and other retiral benefits.
There is no dispute that the petitioners have attained the age of superannuation on 3U' May 2013 & 3 July, 2013 respectively. There is no dispute that the charge sheets have been issued against both the petitioners By:AMULYA
on 29th May, 2013 and 11'*^ July, 2013 respectively. The learned counsel for the petitioners concedes, in terms of the rules, the disciplinary proceedings can be continued after the petitioners have attained the age of superannuation. He states, the disciplinary proceedings are delaying the release of gratuity and other retiral benefits. He also states, it would be appropriate that this Court give a direction to the respondent nos. 1 to 3 to complete the proceedings within a period of four months from today.
This submission of the learned counsel for the petitioners is acceptable to the learned counsel for the respondent nos. 1 to 3. Accordingly, it is directed that the disciplinary proceedings pending against the petitioners shall, subject to the parties cooperating with the Enquiiy officer, be completed within a period of four months from today. It is expected that the final order shall be passed by the disciplinary authority within the period fixed by this order.
In case the petitioners are aggrieved by final order passed by the disciplinaiy authority, petitioners are at liberty to invoke remedy available under the rules before approaching the Court. T|je petitions are disposed of.
