1. Learned counsel for the parties agree that the present petition be disposed of in terms of order dated 3rd October 2016 in Arbitration Petition No. 428 of 2016 (Amritashwa v. U.P. Infraestate Private Limited).

2. Accordingly, with the consent of the parties, it is directed that an Arbitrator be appointed under the Rules of the Delhi International Arbitration Centre (DIAC). The representatives of the parties shall appear before the Co-ordinator, DIAC on 22nd November2016 at 11 am. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

3. The petition is disposed of.
