This is a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.150/2008, under Sections 498-A/406/34 of the Indian Penal Code, 1860, PS:Tilak Nagar, Delhi and subsequent proceedings arising therefrom.

Learned counsel for the parties submitted that a settlement has been effected between the parties vide settlement dated 15.7.2017 before the Delhi Mediation Centre, Tis Hazari Courts, Delhi, in terms whereof the parties have been granted divorce by the competent court and now a sum of Rs.1,00,000/- is required to be paid.

Respondent No.2, who is present in Court, has been identified by the Investigating Officer as well as her counsel. Respondent No.2 submitted that the settlement has been effected on her own free will, without any force, pressure or coercion and that in view of the settlement, the present petition may be allowed.

In view of the aforesaid circumstances, the settlement effected between the parties and the balance payment of Rs.1,00,000/- received by respondent No.2 today in Court by way of demand draft No.207126, dated 1.11.2018, drawn on Kotak Mahindra Bank, this Court is of the view that no fruitful purpose would be served in keeping them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No.150/2008, under Sections 498-A/406/34 of the Indian Penal Code, 1860, PS:Tilak Nagar, Delhi and subsequent proceedings arising therefrom are quashed. The parties shall remain bound by the terms of the settlement.

Petition is disposed of in above terms. Pending applications are also disposed of.
