% 04.08.2016 CRL.M.A. 11897/2016 (exemption) Allowed, subject to just exceptions.

The application is disposed of.

CRL.M.C. 2793/2016 & CRL.M.A. 11896/2016 By this petition, the petitioner seeks quashing of FIR No. 286/2014 under Sections 354-B/323/341/506/34 IPC registered at Police Station New Friends Colony, on the complaint of Farjana, respondent No.2 herein. Notice. Learned Additional Public Prosecutor accepts notice. He submits that earlier also an FIR was registered on the complaint of Farjana against the petitioner Mohd. Bilal for the offence punishable under Section

306 IPC and the same was settled, whereafter the FIR was quashed. Besides, the present FIR, there is one more FIR No.41/2010 under Section 325/506/34 IPC registered against the petitioner Mohd. Bilal. Even though the parties may have settled, considering the fact that this is the third offence by Mohd. Bilal and the second offence qua Farjana, where besides Farjana two others have also been injured, I do not find it a fit case for quashing of the FIR.

The petition is accordingly dismissed.
