Vide the present petition, the petitioner seeks a direction to the respondent no.2 to demolish the alleged illegal and unauthorised construction made on Flat nos.C-8/8210 and C-8/8203, Third Floor, Vasant Kunj, New Delhi. He also seeks a direction to the respondent nos.1 and 2 authorities to ensure that no unauthorized construction is made on the aforesaid flats.

Ms.Arunima Dwivedi, Advocate who appears on behalf of the respondent no.2 hands over a status report which is taken on record. As per the status report, the unauthorised construction found on the aforesaid flats have already been booked under Section343 and 344(1) of the Delhi Municipal Corporation Act.

Learned counsel for the respondent no.2 states, on instructions, that further action in respect of the aforesaid construction shall be taken expeditiously as per the provisions of the Act subject to the police force being made available.

In view of the aforesaid statement made by the respondent no.2, clearly stating that appropriate action in respect of the aforesaid property has already been initiated and respondent no.2 will take further appropriate action in accordance with law, learned counsel for the petitioner does not press the present writ petition any further. He, however, seeks liberty to approach this Court, again in case the need arises.

The petition is dismissed as withdrawn with liberty as prayed for.
