O R D E R

% 06.09.2018 Respondent nos. 2 and 3 are husband and wife. Similarly, respondent nos. 4 and 5 are husband and wife. Disputes arose between petitioners and respondent nos. 2 to 5 in respect of commercial transactions regarding opening of beauty salons. It is submitted that petitioner and respondent nos. 2 to 5 have now settled their disputes amicably vide two separate settlement deeds, that is, Settlement Agreement dated 11th November, 2017 and Memorandum of Understanding dated 30th May, 2018, therefore, FIR No.808/2016 under sections 420/406/120B IPC registered at police station Rajouri Garden which is at investigation stage, may be quashed.

Respondent nos. 2 to 5 submit that they have settled their disputes with the petitioners of their own free will and without any undue force, pressure or coercion. Respondent nos. 2 and 3 submits that they have already received the settled amount amounting to `45 lacs from the petitioners.

Today Petitioners have paid `7.5 lac to respondent nos. 4 and 5 vide a demand draft, photocopy whereof has been placed on record. Respondent nos. 4 and 5 submit that entire settled amount stands paid with this payment. Respondents nos. 2 to 5 submit that they have no objection in case aforesaid FIR is quashed. Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 5 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
