Learned counsel for the appellant submits that he summoned record of the criminal case relating to FIR No. 240/2012 dated 31st July, 2012 under Sections 287/304A IPC, P.S. Alipur before the Commissioner, Employees' Compensation.

However, the same could not be sent by the concerned Court as the said record had been summoned by this Court. It is submitted that the record of FIR No. 240/2012 be sent to the Commissioner, Employees' Compensation where the proceedings are listed on 1st September, 2017.

The Registry is directed to send the record of FIR No. 240/2012 dated 31st July, 2012 under Sections 287/304A IPC, P.S. Alipur to the Court of Sh. Lallan Singh, Commissioner, Employees' Compensation, District NorthWest, Labour Welfare Centre, Nimri Colony, Ashok Vihar, Phase - IV, Delhi - 110052, by a special messenger.

The Commissioner Employees' Compensation shall return the said record to the Court of Sh. Vishal Gogne, Chief Metropolitan Magistrate, Court No. 115, Rohini Court, Delhi after the recording of the evidence. 4.

This appeal has already been disposed of on 26th July, 2017 and need not be listed again.

At the request of learned counsel for the appellant, it is clarified that nothing stated in the judgment dated 26th July, 2017 be construed as a final expression on the merits of the case.

Copy of this order be given dasti to the counsel for the parties under the signatures of the Court Master.
