O R D E R

% 01.08.2016 By the present petition the petitioner who is the father-in-law of the complainant seeks anticipatory bail in FIR No.410/2016 under Sections 328/498A/34 IPC registered at PS Shahbad Dairy. Learned counsel for the petitioner submits that the petitioner be granted anticipatory bail on parity with his wife as per the order dated 25th July, 2016 passed by this Court in BAIL APPLN.1455/2016. Heard learned counsel for the complainant as well who states that the allegations against the petitioner are serious in nature.

Learned APP for the State on instructions submits that the role assigned to the petitioner is same as of Krishna Devi. The allegations against Krishna Devi were that she caught hold of the hands of the complainant whereas petitioner caught her legs and their son administered some poison.

This Court while granting bail to the mother-in- law noted the allegations made by the complainant wherein she stated that she was married to the son of the petitioner on 14th January, 2013 and a baby girl was born out of the wedlock. She was tortured for bringing less dowry. During the course of hearing of the divorce petition filed by the son of the petitioner on 22nd April, 2016 he agreed to take her back and thus from 1st May, 2016 she was taken back to her matrimonial home. However, after 2-3 days her inlaws again started misbehaving with her. The allegations for 15th May, 2016 are that at around 9.30 - 10.

30 PM after dinner when she was sitting in her room, the petitioner caught hold of her legs, the mother-in-law her hands and the son of the petitioner put some liquid in her mouth where after she became unconscious and was admitted in the hospital by PCR official. As per the MLC the complainant was admitted in the hospital by Head Constable Ramesh. When she was admitted she was stable, conscious and oriented and the alleged history given by the complainant was of poisoning by medicine i.e. 8-9 tablets of paracetamol 325 mg. Considering the facts and circumstances of the case I deem it fit to grant anticipatory bail to the petitioner.

the satisfaction of the Arresting Officer/ SHO concerned, subject to the condition that the petitioner will join the investigation as and when directed and will not leave the country without the prior permission of theCourt concerned.

Petition is disposed of. Order dasti.
