O R D E R

By this petition, petitioner seeks parole on the ground that he has to file special leave petition before the Hon'ble Supreme Court and maintain social ties.

On a notice being issued a status report has been filed. As per the status report, family of the petitioner was found residing at District Jalpaigudi, West Bengal. During the course of verification the elder sister, brother-in-law and the neighbour of the petitioner opposed his release on parole citing that he may disturb the tranquillity in the area. Further the status report discloses that in District Jalpaigudi, West Bengal three cases were registered against the petitioner being FIR Nos.115/1993 under Sections 147/148/149/307 IPC; 10/1994 under Section 147/148/149/324/307 W.P.(CRL) 2173/2018

IPC at PS Lalchini, District Jalpaigudi, West Bengal and 27/1998 under Sections 302/201/34 IPC. Petitioner is undergoing conviction for offence punishable under Sections 302 IPC in case FIR No. 421/2013 registered at PS Burari, Delhi wherein the life sentence of the appellant has been upheld by this Court on 10th January, 2017.

A perusal of the status report and the nominal roll would reveal that while on bail in FIR No. 115/1993 and 10/1994 under Section 307 IPC, petitioner was involved in FIR No.27/1998 under Section 302/201/34 IPC wherein trial is still pending before the Court. It appears that after release on bail in FIR No.27/1998 the petitioner is now involved in Delhi in FIR No.421/2013 under Section 302 IPC.

Considering the chequered history of the petitioner, the apprehension of his family members cannot be said to be unsubstantiated. Thus this Court finds no ground to grant parole to the petitioner. 5.

Petition is dismissed.

Petitioner would be at liberty to file Special Leave Petition before the Supreme Court through the legal aid available in jail. 7.

Copy of the order be communicated to the petitioner through Superintendent, Mandoli Jail.
