Present two appeals have been filed under Section 299 of Indian Succession Act and challenge the judgment/order dated 27.08.2008 whereby the probate petitions i.e. PC No. 324/2006 and PC No. 325/2006 had been dismissed.

In both the aforesaid matters, identical applications have been moved under Section 151 CPC praying therein that in view of the fact that matter has FAO 390/2008 & FAO 410/2008 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been amicably settled amongst the family members, the present appeals may be permitted to be withdrawn.

Along with the aforesaid applications, copy of the settlement which took place before the Delhi Mediation Centre, Tis Hazari Courts, Delhi has also been annexed in which it has been very clearly recorded that appellants herein would take steps to withdraw the present appeals i.e. FAO No. 390/2008 and FAO No. 410/2008.

In view of above development and in view of the above-said settlement, the applications are allowed and, resultantly, appeals are permitted to be withdrawn.

Appeals stand disposed of in the aforesaid terms.
