None is present on behalf of the plaintiff. On the last date when the case was taken up on 01.02.2016, none had appeared for the plaintiff. It was recorded in the order dated 01.02.2016 that despite the order dated 13.07.2015, the plaintiff had not filed the application for seeking amendment of the plaint. The position remains the same today. 2.

It appears that the plaintiff is not interested in prosecuting the suit, which is accordingly dismissed in default and for non-prosecution alongwith the pending application.
