% 08.05.2018 The petition at hand was filed to assail the order dated 18.08.2010 of the Civil Judge on the file of execution case no. 90/2007 whereby the proceedings in the execution petition taken out by the petitioners with reference to order dated 24.08.2007 recorded on the file of civil suit (suit no. 179/2007) were closed, the observations recorded being that the petition was not maintainable.

The petition was presented through Mr. S.A. Khan, Advocate who has moved an application (CM No. 18802/2018) seeking permission to withdraw his vakalatnama. The application is accompanied by copy of a formal notice issued by him on 17.06.2017 to the first petitioner indicating his intention to do so and requiring his presence in the court on 09.08.2017 which was the date of hearing then fixed. No one has been appearing for the petitioners on the last three preceding dates. There is no appearance on CM(M) 1591/2010

behalf of the petitioners even today. The application of Mr. S.A. Khan, Advocate is allowed and he is discharged from his responsibility in the matter.

Since there is no one present on behalf of the petitioner on the matter being called out, the petition and the applications are dismissed in default. R.K.GAUBA, J.
