By this joint application, the plaintiff and defendant/counter claimant seek withdrawal of the suit as parties have settled the matter. 2.

The terms of settlement are incorporated in Annexure (A) to the present application.

Taking the settlement on record, application is disposed of permitting the parties to withdraw the suit and counter claim. CS(COMM) 882/2016 and CC No. 95/2010 1.

Parties have settled the matter vide Deed of Settlement dated 19th September, 2017 annexed as Annexure (A) to I.A. No. 11238/2017. 2.

The application is supported by the affidavit of Mr. Sanjay Nandlal Ahuja authorised signatory of the plaintiff's company authorisation in whose CS(COMM) 882/2016

favour is at page 15 of I.A. 11238/2017.

The application is also supported by the affidavit of Mr. Vineet Gupta on behalf of defendant/counter claimant, authorisation in whose favour is at page 16 of I.A. No. 11238/2017.

As parties have settled the matter suit and counter claim are dismissed as withdrawn.
