% 10.11.2016 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.398/16 under Sections 325 IPC registered at Police Station Nihal Vihar. Offences under Sections 354-D/354/506/509 IPC and Section 12 POCSO Act were added subsequently. Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file. Initially FIR under Section 325 IPC was registered against the petitioner on the complaint of Mohd.Javed-victim's father on 23.05.2016.
He did not level any allegations of outraging of modesty of her daughter. Status report reveals that the petitioner was admitted to bail under Section 325 IPC. Subsequently, on 23.06.2016 BAIL APPLN. 1451/2016
in her statement under Section 164 Cr.P.C. the victim levelled allegations of outraging of her modesty by the petitioner.
Consequently, Sections 354-D/354/506/509 IPC and Section 12 POCSO Act were added. By an order dated 22.07.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation.
(3) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(4) The bail application stands disposed of.
