W.P.(C) 6322/2016 and CM No. 25939/2016 Petitioner is aggrieved by the unauthorized and illegal construction being carried out on the first floor and second floor of the property bearing no. 70, Block-D, Anand Niketan, Co-operative House Building Society, New Delhi. His submission is that he is the owner of the ground floor and this illegal activity is stated to be carried out on the first floor and the second floor of the property; photographs have been shown to the Court wherein malba and cement

were accumulated on the ground floor courtyard. Additional submission being that apart from this illegal activity, the main gate has also been locked by respondent no. 2 which has created difficulty to the occupants of the ground floor to have access to the property. On advance notice respondent no. 1 has put in appearance. His submission is that this property had been booked on 15.07.2016 on the complaint of the petitioner dated 11.07.2016. Work stop notice has been given to R-2 on 20.07.2016. Counsel for respondent no. 1 further submits that the concerned Police Station at Anand Niketan has also been communicated and they will ensure that no further illegal construction activity will be carried out in the first floor and the second floor of the property. Further submission of the respondent no. 1 is that all actions will be taken in accordance with law. In view of the aforenoted undertaking furnished by respondent no. 1, no further orders are called for in this petition. Petition disposed of in the above terms.
