CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 28.08.2018 1.
By this petition, petitioner seeks parole to maintain social ties and arrange money for his sister's marriage and also challenges the communication dated 18th May, 2018 rejecting the application of the petitioner seeking parole on the grounds mentioned above. As per the nominal roll on record, the petitioner has been awarded sentence of imprisonment for a period of four years and to pay fine totalling `1,25,000/- on various counts in default whereof to undergo simple imprisonment for 24 months cumulatively. Out of the sentence of 7 years awarded, remaining sentence of the petitioner is 3 months and thus after completion of this approximate 3 months, the petitioner has to undergo sentence in default of payment of fine in case fine is not paid which cannot be suspended/remitted or parole granted therein.
2.
Considering the fact that after 3 months, the petitioner has to undergo sentence in default of payment of fine and that the offence alleged against the petitioner is serious in nature coupled with the unsatisfactory conduct of the petitioner in jail, this Court finds no ground to grant parole to the petitioner.
3.
Petition is dismissed.
4.
Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
