O R D E R

% 31.08.2015 I.A. No. 17999/2015 (u/O 23 R 3 CPC) Parties have settled their disputes on the terms and conditions as stipulated in para 4 of the application which has been signed by the parties and their counsel, inasmuch as, application has been supported by their affidavits.

As regards plaintiff is concerned, application has been signed through the constituted Attorney of the plaintiff who has filed the suit as well. I do not find the terms of compromise to be in conflict with the law. In terms of the settlement, key of the suit property has been handed over by the counsel for the defendant no.1 to the counsel for the plaintiff today in Court.

Accordingly, suit is decreed in terms of the application, which is

marked as Mark C-1 which shall form part of the decree. Date fixed in the matter, that is, 15th September, 2015 is hereby cancelled. Since parties have settled their disputes before the commencement of evidence, let 50% of the court fee be refunded to the plaintiff. Application is disposed of in the above terms. A.K. PATHAK, J.
