% 16.11.2017 CA No.1755/2017 This is an application under Rule 9 of Company Court Rules, 1959 for non-payment of admitted debt. The parties entered into settlement agreement/MOU dated 6.3.2017 wherein an amount of 32,00,457.59 paise was to be paid by the respondent company to the petitioner by way of seven cheques. In addition to the aforesaid amount the TDS of 3,90,237/- was also to be deposited. It is submitted that neither TDS has been deposited nor such amount have been given to the petitioner.

Issue notice to the respondent by all modes returnable for 12th January, 2018.
