% 29.10.2015 We have heard the learned counsel for the parties. The learned counsel for the respondent states that since there are some disputes between the parties which cannot be resolved amicably, the same would have to be referred to the adjudicator by either party in terms of clause 23.2 of the bidding document / agreement between the parties. The learned counsel for the respondent states that the adjudicator shall be appointed by the Chairman and Managing Director of the respondent within one week from today. Thereafter the procedure prescribed under the bidding document / agreement between the parties and, in particular, clause 23 for dispute resolution shall be followed by the parties. In view of the above development, the learned counsel for the petitioner seeks permission to withdraw this writ petition. The same is dismissed as withdrawn.
