JUDGMENT

16.08.2017 SANJEEV SACHDEVA, J. (ORAL) CS(OS) 3127/2011 & IA No.9181/2017 (under Order XXIII Rule 3 CPC for recording of compromise) 1.

IA No.9181/2017 is a joint application on behalf of the plaintiff as well as the defendant Nos. 1 to 4 for disposing of the Suit in terms of a settlement.

It is submitted that the parties have settled their disputes and the terms of settlement have been recorded in Compromise Deed dated 05.08.2017. The Compromise Deed dated 05.08.2017 is signed on behalf CS(OS) 3127/2011

of the plaintiff by the Director and by the defendant Nos.1 to 4. The application is signed by the plaintiff as well as the defendant No.2 for self as well as for defendant No.1 and by the defendant Nos.3 and 4. The application is also supported by an affidavit of the plaintiff as also by the defendant No.2 for himself as also for the defendant No.1 and by the affidavits of defendant Nos.3 and 4. The compromise deed dated 05.08.2017 is marked as Exhibit C - 1.

The terms of settlement have been recorded in the Compromise Deed Exhibit C - 1. I have perused the terms of the settlement and find them to be lawful.

Learned counsel for the parties submit that the parties have, after the execution of the Compromise Deed, carried out their respective obligations. They pray that the suit be decreed in terms of the Compromise Deed dated 05.08.2017.

In view of the above, the application is allowed. 6.

The suit is, decreed in terms of Exhibit C - 1. The Compromise Deed Exhibit C - 1 shall form part of the decree. Further dates before the local commissioner are cancelled.

Decree sheet be prepared accordingly.
