The present appeal has been filed under Section 378(4) CrPC by the appellant/complainant against the judgment dated 15.10.2009, passed by Learned MM, Rohini Courts in the case bearing CC No.3544/08 vide which the Respondent was acquitted of the offence under Section 138 NI Act.

Learned counsel for the appellant, on instructions, seeks leave to withdraw the present appeal.
