+ CRL.M.C. 3701/2018 SUMIT SABHARWAL & ORS ..... Petitioners Through Mr. Upkar Singh Randhawa, Adv versus STATE & ANR ..... Respondents Through Dr. M P Singh, APP for State ASI Dushyant, PS Vikas Puri Ms. Nikita Sharma, Adv for R-2 with R-2 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 04.09.2018 Respondent no.2-Rekha is present in Court along with her counsel and has been identified by ASI Dushyant of police station Vikas Puri.
Respondent no. 2 (wife) says that she has settled the matter with petitioner no. 1 (husband) of her own free will and without any undue force, pressure or coercion. She has started living with petitioner no. 1 for last one year and she has no grievance against petitioner no.1 as on today. She further says that she has no objection in case FIR No.410/2016 under Sections 498-A/406/34 IPC registered at Police Station Vikas Puri on the complaint of respondent no. 2 and the consequent proceedings emanating therefrom are quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3. Affidavit of respondent no.2, to this effect, is on record.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep them entangled in the criminal proceedings. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K.
