O R D E R

The present contempt petition has been filed alleging disobedience of the order dated 05th March, 2018 passed in W.P.(C) 17858/2004.

The present petition alleges that the petitioner obtained a favourable th order dated 24 July, 2004 passed by the learned Labour Court, which mandated the reinstatement of the petitioner with full back wages and all consequential benefits from the date of termination till the date of his reinstatement.

Thereafter, the aforesaid decision of the learned Labour Court was th modified by the learned Single Judge of this Court vide judgment dated 05 March, 2018 in W.P.(C) 17858/2004, wherein it was directed that the petitioner shall be entitled to a payment equivalent to 30% of the wages that the petitioner would have earned until superannuation. Since it was the allegation of the petitioner that less payment had been made to the petitioner, the present contempt petition has been filed. Mr. Raj Birbal, learned Senior Advocate along with Ms. Raavi Birbal, Advocate appearing for respondent, submit that full payments in terms of the aforesaid judgment have already been released to the petitioner herein. They have handed over a copy of the order dated 14th February, 2024 passed by the Supreme Court in Civil Appeal No. 2453 of 2024, titled as Vimal Kumar Mehta Versus M/s Engineers India Ltd., which is taken on record. They submit that by way of the aforesaid order, the Supreme Court had closed all the proceedings, including the contempt proceedings arising out of the termination order.

Attention of this Court has been drawn to Para - 10 of the aforesaid th order dated 14 February, 2024 passed by the Supreme Court, which reads as under:
"xxx xxx xxx
10. This order will bring closure to all other proceedings including the contempt proceedings arising out of termination order. xxx xxx xxx."

None appears for the petitioner when the matter is called out. This Court notices that no one has been appearing for the petitioner for the last many dates.

Considering the submissions made by the learned counsel for respondent and in view of the order dated 14th February, 2024 passed by the Supreme Court in Civil Appeal No. 2453 of 2024, the present contempt petition is found without any merits.
