% 08.02.2016 CA 370/2016 (condonation of delay) 1.
This is an application filed by the petitioner seeking condonation of delay in filing a rejoinder. There is a delay of 151 days. 2.
For the reasons given therein the application is allowed, and the delay is condoned. The application is, accordingly, disposed of. CP 601/2014 & C.A.2274/2014 3.
Learned counsels for the parties, after some arguments, are agreed that the petition can be disposed of with following directions: (i) Against the amount claimed by the petitioner, a total sum of Rs. 6 lacs will be paid to it by the respondent, within two weeks from today. (ii) With this, there shall be no claim left with respect to the claim raised in the present petition.

The petition is disposed of in the aforesaid terms. No further orders are called for. Needless to say, if the respondent fails to make the payment within the stipulated time, the petitioner will have the liberty to revive the present petition.

Mr Kumar, on behalf of the respondent, undertakes to abide by the terms of the settlement.
