By the present leave petition, the petitioner challenges the judgment of acquittal dated 16.05.2018 (hereafter 'impugned judgment'), passed by the learned Trial Court in CC No. 39866/2016.

The learned Additional Public Prosecutor for the State submits that the impugned judgment has been passed by wrongly recording that the Public Analyst Report (PA Report) has passed the sample of "Milk" in fat which is in variation with the CFL Report which reports that the milk sample did not conform to standard.

He submits that the PA Report categorically affirmed that the sample does not conform to standard because milk solids not fat is less than the prescribed minimum limit of 9%. 4.

He submits that pursuant to the PA Report, sanction was obtained and prosecution complaint was filed. 5.

The State has made out a prima facie case for considering the appeal.

In view of the above, the leave to appeal is granted. The appeal be numbered accordingly.
