CRL.M.C. 2582/2016 & Crl.M.A. 11085/2016 (stay) Learned counsel for the petitioner urges that the documents mentioned in the application copy whereof is at page 66 of the paper book which were sought to be produced by filing an application under Section 91 Cr.P.C. before the learned Trial Court arose on 17th May, 2014 when on cross-examination, the authorized representative of the complainant stated that he was not aware of how many circulars in respect of the meeting of the Directors had been transacted and whether they were filed before the ROC or not. In cross-examination he further deposed that he could produce the balance sheets in the Court if required.
After some arguments learned counsel for the petitioner points out that the Trial Court is delivering the decision today. CRL.M.C. 2582/2016
However, the application under Section 91 Cr.P.C. was filed only 10 days ago when the matter was listed for final decision. I find no reason to interfere in the impugned order whereby the learned Trial Court has held that there is delay in filing the application. Petition is dismissed.
